Welcome to Biler! By using our app, which helps you manage billing, inventory, staff, and shop operations, you agree to comply with these Terms of Use. Please read them carefully. If you do not agree with any part of these terms, do not use our app.
Interpretation and Definitions
Interpretation
The words with capitalized initial letters have specific meanings defined below. These definitions apply regardless of singular or plural forms.
Definitions
For these Terms and Conditions:
- Application refers to the Biler software program provided by the Company, downloaded by you on any electronic device.
- Application Store means the digital distribution service operated by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) where the Application is available.
- Affiliate means an entity controlling, controlled by, or under common control with a party, where “control” implies 50% or more ownership of shares, equity, or voting rights.
- Country refers to: India.
- Company (referred to as either “the Company,” “We,” “Us,” or “Our” in this Agreement) refers to Biler.
- Device refers to any device capable of accessing the Service, such as a smartphone or tablet.
- Service refers to the Application.
- Terms and Conditions (also referred to as “Terms”) mean these Terms and Conditions that form the entire agreement between you and the Company regarding the use of the Service.
Acknowledgment
These Terms govern your use of this Service and form the agreement between you and the Company. Your access and use of the Service are subject to your acceptance of and compliance with these Terms, which apply to all users, including visitors and account holders.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service. You also confirm you are over 13 years old; Biler does not permit children under 13 to use the Service.
Your use of the Service is also subject to the Company’s Privacy Policy, which explains our policies and procedures regarding the collection, use, and disclosure of your personal information. Please review it carefully.

Termination
We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately.
Limitation of Liability
To the maximum extent permitted by Indian law, the Company or its suppliers shall not be liable for any indirect, incidental, or consequential damages, including loss of data, financial loss, or privacy issues arising out of or related to your use of or inability to use the Service.
In no event shall the total liability of the Company exceed the greater of INR equivalent of 100 USD or the amount actually paid by you through the Service. Some jurisdictions do not permit certain limitations, so the above limitations may not apply to you.
“AS IS” and “AS AVAILABLE” Disclaimer
The Service is provided “AS IS” and “AS AVAILABLE,” with all faults and defects, without warranty of any kind. To the maximum extent permitted by Indian law, the Company disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
The Company makes no guarantee that the Service will meet your requirements, operate without interruptions, or be free of errors or defects.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, including the Digital Personal Data Protection Act, 2023 (DPDP Act), without regard to conflict of law provisions. You agree to comply with applicable local, state, and national laws, including GST obligations where applicable.

For European Union (EU) Users
If you are a consumer in the European Union, you are entitled to the protections under the law of your resident country.
United States Legal Compliance
By using this Service, you represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. government list of prohibited or restricted parties.
Severability and Waiver
Severability
If any provision of these Terms is deemed invalid or unenforceable, that provision will be modified to fulfill its purpose to the greatest extent possible under applicable law, and the remaining provisions will remain in effect.
Waiver

Translation Interpretation
If we provide these Terms in multiple languages, the English version shall prevail in case of disputes.
Changes to These Terms and Conditions
We reserve the right to modify or replace these Terms at our discretion. If a revision is significant, we will attempt to provide at least 30 days’ notice prior to new terms taking effect.
Continuing to access or use our Service after the changes take effect means you accept the revised terms. If you do not agree to the new terms, please stop using the Service.
